What is a Misdemeanor in Texas?

Misdemeanors are crimes in the State of Texas which are punishable by up to one year in county jail. The Texas legislature divides misdemeanor offenses into three classes: Class A, Class B, and Class C. Each of these classes carries its own punishment range, including the amount of time you can be imprisoned, and the amount you may owe in fines.

Class A Misdemeanors

Class A misdemeanors are the most serious level of misdemeanor in Texas, punishable by up to a year in a county or local jail, and a potential fine up to $4,000. Some examples of Class A misdemeanors include:

  • Driving While Intoxicated (BAC > .15)
  • Driving While intoxicated (2nd Offense)
  • Assault causing bodily injury
  • Assault causing bodily injury to a family member
  • Possession of marijuana (2 – 4 ounces)
  • Burglary of a vehicle
  • Unlawful restraint
  • Theft ($750 – $2,500)

Class B Misdemeanors

Class B misdemeanors are the intermediate level of misdemeanor in Texas, punishable by up to 180 days in a county or local jail, and a potential fine up to $2,000. Some examples of Class B misdemeanors include:

  • Driving While Intoxicated (1st Offense)
  • Criminal Trespass
  • Possession of marijuana (less than 2 ounces)
  • Harassment
  • Terroristic Threat
  • Theft ($100 – $750)

Class C Misdemeanors

Class C misdemeanors are the least serious level of misdemeanor in Texas, and are punishable by fine only, up to $500. Some examples of Class C misdemeanors include:

  • Traffic Tickets
  • Minor in Possession of Alcohol
  • Minor in Consumption of Alcohol
  • Theft under $100
